Please read these terms carefully before using Smart Logistic's services. By accessing our platform, you agree to be bound by these terms.

*About Smart Logistics Platform

Smart Logistics Platform, owned by Alttatabu Aldhaki Establishment for Logistics, is a limited liability company duly registered in the Kingdom of Saudi Arabia under Commercial Registration No. 1009079933, with its headquarters located in Riyadh.

The Smart Logistics Platform is a modern, technology-driven digital platform that delivers comprehensive transportation and logistics solutions. It connects businesses and individuals requiring goods transportation with qualified carriers who operate suitable and approved trucks. The platform supports a wide range of transport services, covering all truck types and serving all regions across Saudi Arabia, with a strong focus on safety, efficiency, and reliability.

Through the Smart Logistics Platform, users can easily request transport services, monitor shipments in real time, and access detailed tracking and status reports. The platform is committed to maintaining the highest standards of service quality, operational excellence, and safety, in full compliance with all applicable laws and regulations of the Kingdom of Saudi Arabia.

*Acceptance of Terms

By using Smart Logistics, you agree to comply with these terms and conditions, which constitute a legally binding agreement between you and Smart Logistics.

*Service Description

Smart Logistics provides an electronic platform that connects customers needing transportation services with carriers who own suitable trucks. Services include daily and monthly rentals and other logistics solutions.

*User Responsibilities

Accurate Information

You must provide accurate and complete information when creating your account and using our services. Misrepresentation may lead to the suspension or termination of your account.

Compliance with Laws

You agree to comply with all applicable laws and regulations while using our platform. Violations may lead to suspension or termination of your account.

Prohibited Activities

You must not use our platform for any illegal or unauthorized purposes, including transporting prohibited materials or engaging in fraudulent activities.

*Fees and Payments

Service Fees

You agree to pay all fees associated with using our services, as detailed on our platform. These may include rental fees, overtime charges, and late penalties.

Payment Terms

Payments must be made through the methods specified on our platform. Delayed payments may lead to suspension or termination of your account.

*Bookings and Cancellations

Booking Process

All bookings must be made through the Smart Logistics platform. You will receive confirmation once your booking is accepted.

Cancellation Policy

Cancellations are subject to the terms outlined in our service policies. Cancellation fees may apply depending on the timing and nature of the cancellation.

*Liability and Indemnification

Limitation of Liability

Smart Logistics is not liable for any direct, indirect, incidental, consequential, or punitive damages arising from your use of the platform or services provided.

Indemnification

You agree to indemnify and hold Smart Logistics, its affiliates, officers, directors, employees, and agents harmless from any claims or damages arising from your use of the platform or your breach of these terms.

*Dispute Resolution

Negotiation

In the event of a dispute, parties should first attempt to resolve it through direct negotiation within fifteen (15) days.

Arbitration

If a resolution is not reached through negotiation, disputes will be settled through arbitration according to the rules of the Saudi Center for Commercial Arbitration. Arbitration will take place in Riyadh, Saudi Arabia, and proceedings will be conducted in Arabic.

*Termination

Termination by Smart Logistics

Smart Logistics reserves the right to terminate your account at any time for any reason, with or without notice.

Termination by User

You can terminate your account by deleting the app and ceasing to use our services.

*Intellectual Property

All content on the Smart Logistics platform, including text, graphics, logos, images, and software, is owned by Smart Logistics or its licensors and is protected under intellectual property laws. You may not use any of this content without express written permission from us.

*General Provisions

Entire Agreement

These terms and conditions constitute the entire agreement between you and Smart Logistics regarding the use of our services.

Applicable Law

This agreement is governed by the laws of the Kingdom of Saudi Arabia, and any disputes will be resolved in Saudi courts.

Severability

If any provision of these terms and conditions is found to be invalid or unenforceable, the remaining provisions will remain in effect.

*Policy Cancellation

Conditions for Insurance Cancellation for the Customer

"Smart Logistics Tracking" reserves the right to cancel insurance or reject compensation requests in the following cases:

Non-compliance with Warranties

Failure by the insured to comply with any warranties or improve risks in the manner and time specified in this document.

Misrepresentation and Non-disclosure

Any fraudulent misrepresentation or failure by the customer to disclose any material fact regarding the risks.

Change of Interest or Risk

Any fundamental change in profession, processing procedures, or modifications that increase the risk level.

Right to Reject Compensation

"Smart Logistics Tracking" reserves the right to reject or not submit a compensation request if any insurance terms are violated.

Acknowledgment of Receipt

Closing the order on the app or providing the confirmation code to the driver constitutes final acknowledgment of the shipment's safety; no claims for damages shall be accepted thereafter.

Improper Packaging and Overloading

Damages resulting from unsafe internal packaging, exceeding the truck's legal load capacity, or shipping legally prohibited/hazardous materials.

Refusal of Inspection

If the customer refuses to allow the truck driver to inspect the goods to verify their safety and suitability for the truck before loading.

Violation of Regulations

Directing the driver to violate traffic laws or changing the approved route specified in the application.

Carrier's Liability for Insurance (Company & Driver)

"Smart Logistics Tracking" is exempt from liability for insurance claims, and the Carrier bears full responsibility for paying compensation to the customer in the following cases:

Failure to Inspect and Document

Negligence by the truck driver in inspecting the goods, or failure to upload mandatory documentation photos (at loading and unloading) via the app, making the carrier liable for any resulting damage.

Reporting Deadline (30 Minutes)

Forfeiture of the right to claim against the platform and the carrier's full liability if "Smart Logistics Tracking" is not notified within 30 minutes of the incident causing the damage.

Truck Breakdowns

The carrier is liable for paying compensation for shipment damages resulting from technical or mechanical failures of the truck.

Data and Destination Changes

Full liability of the carrier if damage occurs after changing the registered truck or driver, or delivering the shipment to an unregistered address without prior authorization.

Traffic Violations

The carrier is liable for compensation for damages resulting from traffic violations or driving on unpaved/unsuitable roads for the shipment type.

Driver Negligence

The carrier bears the cost of insurance and full compensation for any damage resulting from the driver's failure to follow safety procedures in the event of damage.

*Service Fees, Cancellation & Delay Policy

Cancellation Fees

TRAILA

  • Before the driver accepts the order: No fee
  • After driver accepts: 120 SAR
  • After arrival at loading site: 240 SAR
  • After loading starts: 540 SAR + 120 SAR per waiting hour

SIX

  • Before the driver accepts the order: No fee
  • After driver accepts: 120 SAR
  • After arrival: 180 SAR
  • After loading starts: 480 SAR + 120 SAR per waiting hour

LORRY

  • Before the driver accepts the order: No fee
  • After driver accepts: 90 SAR
  • After arrival: 150 SAR
  • After loading starts: 300 SAR + 60 SAR per waiting hour

DIANA

  • Before the driver accepts the order: No fee
  • After driver accepts: 60 SAR
  • After arrival: 120 SAR
  • After loading starts: 180 SAR + 60 SAR per waiting hour

Pickup

  • Before the driver accepts the order: No fee
  • After driver accepts: 18 SAR
  • After arrival: 54 SAR
  • After loading starts: 60 SAR + 12 SAR per waiting hour

Delay Fees

TRAILA: 120 SAR after 2.5h (city) / 240 SAR after 3h (outside) + hourly charges
SIX: 120 SAR after 2.5h (city) / 240 SAR after 3h (outside)
LORRY: 90 SAR after 2.5h (city) / 180 SAR after 3h (outside)
DIANA: 60 SAR after 2h (city) / 90 SAR after 3h (outside)
Pickup: 30 SAR after 1.5h delay

Overnight Fees

TRAILA: 420 SAR first day / 1200 SAR additional
SIX: 360 SAR first day / 1080 SAR additional
LORRY: 300 SAR first day / 900 SAR additional
DIANA: 180 SAR first day / 780 SAR additional
Pickup: 150 SAR first day / 300 SAR additional

Loading & Unloading in Vital Areas

Smart Logistics may apply additional operational charges in restricted or high-traffic zones.

TRAILA: 600 SAR
Refrigerated TRAILA: 840 SAR
SIX: 540 SAR
LORRY: 300 SAR
DIANA: 20 SAR
Pickup: 60 SAR

Important Notice
